1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of the Elseland iOS application submitted to the Apple App Store as version v1.0.0 (the “App”) and related services provided by ELSER GLOBAL PTE. LTD. (“we,” “us,” or “our”).

By downloading, accessing, signing in to, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. The App

Elseland is an interactive game experience. In this App Store release, game content is provided by Elseland and displayed through a WebView. The App is a native iOS container for account access, secure session storage, WebView display, and app updates.

Version 1.0.0 does not provide user-generated content features, image or asset uploads, character or world creation tools, public posting, comments, likes, sharing, direct messaging, private chat, AI chat, AI prompt submission, AI content generation, in-app purchases, subscriptions, or virtual currency purchases.

We may add, modify, suspend, or discontinue features in future versions. If future versions add new features, separate or updated terms, policies, or app-store disclosures may apply.

3. Eligibility

The App is not in the App Store Kids Category and is not directed to children. If you are below the age at which you may legally consent to online services in your jurisdiction, you may use the App only with permission and supervision from a parent or legal guardian who agrees to these Terms.

By using the App, you represent that you may lawfully use online services in your jurisdiction and are not barred from using the App under applicable law.

4. Accounts and Sign-In

The App supports only Google Sign-In and Sign in with Apple. You are responsible for keeping your device, Apple ID, Google account, and any related authentication methods secure.

The App may store an authentication token locally in Apple Keychain so you can remain signed in. You agree not to share, sell, transfer, or allow unauthorized access to your account.

We may suspend, restrict, or terminate account access if we reasonably believe that an account is used in violation of these Terms, creates security risk, violates applicable law, or may harm the App, users, or Elseland services.

Notify us at support@elser.ai if you believe your account has been compromised or used without authorization.

5. Account Deletion

You may initiate account deletion inside the App. Deleting the App from your device does not by itself delete your Elseland account on our servers. To delete your account, use the in-app account deletion feature or contact us using the contact details below.

Account deletion is handled as described in our Privacy Policy. Some limited information may be retained where required for legal, security, fraud-prevention, dispute-resolution, backup, or compliance reasons.

6. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, access, and use the App for personal entertainment purposes.

You may not copy, sell, resell, rent, lease, distribute, publicly display, commercially exploit, reverse engineer, decompile, interfere with, or create unauthorized derivative works from the App, except where applicable law expressly permits such activity despite this restriction.

7. Platform Content and Intellectual Property

The App, Elseland name, logos, design, software, interface, artwork, audio, visual materials, game content, characters, stories, scenes, systems, and all other content provided by us or our licensors are owned by us or our licensors and are protected by intellectual property and other laws.

You may access platform-provided game content only through the App as permitted by these Terms. You may not copy, scrape, download, extract, redistribute, sell, modify, or use platform content outside the App without our prior written permission, except as permitted by applicable law.

8. No User-Generated Content in Version 1.0.0

Version 1.0.0 does not allow users to upload, create, publish, share, comment on, like, message, or privately chat with other users through the App. User display names and avatars, where shown, come from the login provider and are not uploaded by users inside the App.

Because user-generated content is not available in this release, you may not attempt to submit, inject, upload, or transmit unauthorized content through the App, WebView, network requests, or any workaround.

9. No AI Processing in Version 1.0.0

Version 1.0.0 does not provide AI chat, AI prompt submission, AI content generation, third-party AI SDKs, or AI model training based on App user data. You may not use the App or its services to attempt to submit prompts, automate requests, extract model behavior, or misuse any future AI-related functionality that is not available in this release.

10. No In-App Payments in Version 1.0.0

Version 1.0.0 does not offer in-app purchases, subscriptions, virtual currency purchases, Apple Pay, Stripe checkout, or other payment features inside the iOS App. If paid features are introduced in a future version, the applicable app-store or payment terms will be presented as required.

11. Acceptable Use

You agree not to use the App to:

• Violate any applicable law, regulation, third-party right, Apple rule, or these Terms.
• Interfere with, disrupt, overload, bypass, or gain unauthorized access to the App, WebView, servers, networks, accounts, or related systems.
• Use bots, scripts, automation, scraping, exploits, unauthorized clients, or reverse engineering to access or manipulate the App.
• Attempt to extract, copy, scrape, download, or redistribute platform-provided content, assets, code, APIs, data, or authentication tokens.
• Impersonate another person or misrepresent your identity, affiliation, or account status.
• Use the App to transmit malware, phishing, spam, scams, fraudulent requests, or harmful traffic.
• Harass, threaten, abuse, exploit, stalk, defame, or harm another person if any communication or reporting channel is available.
• Circumvent account deletion, suspension, access controls, security features, or technical limitations.

12. Third-Party Services

The App may integrate with Google Sign-In, Sign in with Apple, Apple App Store services, Expo/EAS Updates, WebView, hosting and infrastructure providers, and Elseland-controlled web services. Third-party services may be governed by their own terms and policies.

We are not responsible for third-party services that we do not control, but we use them only as needed to operate the App, provide sign-in, deliver updates, display platform-provided content, and maintain security.

13. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect information in connection with the App. By using the App, you acknowledge the Privacy Policy. If these Terms and the Privacy Policy conflict on privacy-specific matters, the Privacy Policy controls for those matters.

14. App Updates and Availability

The App may require updates, including updates delivered through Expo/EAS Updates or the Apple App Store. We may change, suspend, discontinue, or limit parts of the App for maintenance, security, legal, operational, compatibility, or business reasons.

We do not guarantee that the App, WebView content, platform-provided game content, account access, or any feature will be available at all times, uninterrupted, error-free, or compatible with every device, operating system, or network condition.

15. Termination

You may stop using the App at any time and may request account deletion inside the App. We may suspend, restrict, or terminate access to the App or related services if we reasonably believe you violated these Terms, created risk, caused harm, violated law, or exposed us, users, or third parties to legal or security risk.

Upon termination, your right to use the App ends immediately. Sections that by their nature should survive termination will survive, including intellectual property, acceptable use, disclaimers, limitation of liability, indemnification, Apple terms, governing law, and dispute provisions.

16. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND RELATED SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, OR AVAILABILITY.

WE DO NOT WARRANT THAT THE APP, WEBVIEW CONTENT, PLATFORM-PROVIDED GAME CONTENT, THIRD-PARTY SERVICES, OR RELATED SYSTEMS WILL BE ACCURATE, RELIABLE, SECURE, UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, CONTENT, ACCOUNT ACCESS, OR USE, ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100. Because version 1.0.0 does not include in-app payments, this amount will usually be USD $100 unless mandatory law requires otherwise. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

18. Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, directors, officers, employees, agents, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to your use of the App, your violation of these Terms, your violation of law, or your infringement of third-party rights.

19. Apple App Store Additional Terms

If you download the App from the Apple App Store, the following terms apply. These Terms are between you and us, not Apple Inc. (“Apple”). Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government prohibited-parties list.

20. Export, Sanctions, and Compliance

You may not use, export, re-export, or transfer the App except as authorized by applicable law, including export control and sanctions laws. You represent that you are not barred from using the App under applicable sanctions, embargoes, or restricted-party rules.

21. Governing Law and Dispute Resolution

These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules. Subject to mandatory consumer-protection laws that may apply in your country of residence, the courts of Singapore will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the App.

22. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the Last Updated date and, where appropriate, notify users through the App or by other reasonable means. Your continued use of the App after updated Terms become effective means you accept the updated Terms.
